When we talk about the exemption from energy certificates, we refer to the situation where the property owner is exempt from paying fees to the Energy Agency (ADENE) or, in certain cases, is exempt from requesting the energy certificate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Regarding the exemption from fees to ADENE when requesting an energy certificate, there are usually two associated costs: the expert\u2019s service fee, which can vary depending on the company or expert chosen, and the <a href=\"https:\/\/mjarc.com\/en\/adene-fees-energy-certification\/\" target=\"_blank\" rel=\"noopener\">fees payable to ADENE<\/a>, depending on the property type or the size of the commercial space.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Find more information about<\/span> <a href=\"https:\/\/mjarc.com\/en\/energy-certificates-price-in-portugal\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">energy certificate prices here<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is important to highlight two specific situations involving the exemption from fees to ADENE. In the first case, if you already have a valid energy certificate (valid for 10 years) and have implemented measures to improve the building\u2019s energy rating to at least a &#8220;B-&#8220;, you are exempt from paying fees to the Energy Agency. In the second case, if the building is considered a ruin \u2014 that is, unfit for habitation \u2014 you are also exempt from paying ADENE fees. However, there are other situations in which energy certificates are not required, as detailed below.   <\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Exemption from Energy Certificates<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">According to<\/span> <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/decreto-lei\/101-d-2020-150570704\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Decree-Law No. 101-D\/2020 of December 7<\/span><\/a><span style=\"font-weight: 400;\">, certain types of properties are exempt from presenting an energy certificate:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Single-family buildings with a useful floor area equal to or less than 50 m\u00b2;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-residential industrial, livestock, or agricultural facilities and workshops with no current or expected energy consumption related to space heating or cooling intended for human comfort;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Buildings used as places of worship, such as churches, synagogues, mosques, and temples;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Buildings exclusively intended for unconditioned (non-climate-controlled) parking;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Warehouses where human presence does not exceed 2 hours per day or does not represent an occupancy greater<\/span> <span style=\"font-weight: 400;\">than 0.025 persons\/m\u00b2;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Sales or transfers in fulfillment of buildings to a co-owner, tenant, or expropriating entity, when resulting from an enforcement or insolvency process, or when made for their total demolition, subject to prior confirmation by the competent licensing authority;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-remunerated transfers, namely donations, legacies, and inheritances;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rentals of the landlord\u2019s primary residence for a period shorter than 4 months;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rentals to the previous tenant of the building immediately prior to the new legal transaction;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Large commercial and service buildings that are not in operation, provided that they are not sold, transferred in payment, leased, or assigned;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Buildings in ruins;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Military infrastructures and buildings subject to control and confidentiality rules, namely those assigned to security forces and services or information systems;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Commercial and service buildings located within facilities subject to the regime approved by<\/span> <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/decreto-lei\/71-2008-249821\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Decree-Law No. 71\/2008<\/span><\/a> <span style=\"font-weight: 400;\">of April 15, as currently amended.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><b>Improvements for Energy Efficiency<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">In addition to exemptions, it is essential to consider some improvements to increase energy efficiency, namely:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Wall insulation;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Roof insulation;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Renewal of windows and doors;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Replacement of windows and doors;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ventilation systems;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Solar thermal systems;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Heat recovery units and wood-burning stoves;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Water heaters and boilers;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Domestic air conditioning;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Photovoltaic solar systems.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">It is important to highlight that the list of exemptions from energy certificates may be subject to changes or updates in accordance with any future modifications to applicable laws and regulations.
