Dans le premier cas, si vous poss\u00e9dez d\u00e9j\u00e0 un certificat \u00e9nerg\u00e9tique valable pendant 10 ans et avez mis en \u0153uvre des mesures d\u2019am\u00e9lioration de la classe \u00e9nerg\u00e9tique du b\u00e2timent pour atteindre au minimum la classe \u00ab B- \u00bb, vous serez exempt\u00e9 du paiement des frais \u00e0 l\u2019Agence pour l\u2019\u00c9nergie. Concernant le second cas, si le b\u00e2timent est consid\u00e9r\u00e9 comme une ruine, c\u2019est-\u00e0-dire sans conditions d\u2019habitabilit\u00e9, il sera \u00e9galement exempt\u00e9 du paiement des frais \u00e0 ADENE. Cependant, il existe d\u2019autres situations qui dispensent de la n\u00e9cessit\u00e9 de pr\u00e9senter un certificat \u00e9nerg\u00e9tique, comme d\u00e9taill\u00e9 ci-dessous.   <\/span><\/p>\n<p>&nbsp;<\/p>\n<h3><b>Exemption from energy certificates<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Selon le<\/span> <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/decreto-lei\/101-d-2020-150570704\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">D\u00e9cret-loi n\u00b0 101-D\/2020 du 7 d\u00e9cembre<\/span><\/a><span style=\"font-weight: 400;\">, certains types de biens immobiliers sont exempt\u00e9s de pr\u00e9senter un certificat \u00e9nerg\u00e9tique :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">B\u00e2timents unifamiliaux avec une surface utile \u00e9gale ou inf\u00e9rieure \u00e0 50 m\u00b2 ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Non-residential industrial, livestock, or agricultural facilities and workshops without current or anticipated energy consumption related to heating or cooling for human comfort;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">B\u00e2timents utilis\u00e9s comme lieux de culte, notamment \u00e9glises, synagogues, mosqu\u00e9es et temples ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">B\u00e2timents exclusivement destin\u00e9s \u00e0 des parkings non climatis\u00e9s ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Entrep\u00f4ts o\u00f9 la pr\u00e9sence humaine n\u2019exc\u00e8de pas 2 heures par jour ou ne repr\u00e9sente pas une occupation sup\u00e9rieure \u00e0<\/span> <span style=\"font-weight: 400;\">0,025 personnes\/m\u00b2 ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ventes ou remises en paiement d\u2019immeubles \u00e0 un copropri\u00e9taire, locataire ou entit\u00e9 expropriante, lorsqu\u2019elles r\u00e9sultent d\u2019une proc\u00e9dure d\u2019ex\u00e9cution ou d\u2019insolvabilit\u00e9, ou lorsqu\u2019elles sont effectu\u00e9es en vue de leur d\u00e9molition totale, sous r\u00e9serve de la confirmation pr\u00e9alable par l\u2019autorit\u00e9 de d\u00e9livrance des licences comp\u00e9tente ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Transmissions \u00e0 titre gratuit, notamment les donations, legs et successions ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Locations de la r\u00e9sidence principale du propri\u00e9taire pour une dur\u00e9e inf\u00e9rieure \u00e0 4 mois ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Locations \u00e0 l\u2019ancien locataire du b\u00e2timent imm\u00e9diatement avant la nouvelle op\u00e9ration juridique ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Grands b\u00e2timents \u00e0 usage commercial et de services qui ne sont pas en activit\u00e9, \u00e0 condition qu\u2019ils ne fassent pas l\u2019objet d\u2019une vente, d\u2019une remise en paiement, d\u2019une location ou d\u2019un transfert de propri\u00e9t\u00e9 ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">B\u00e2timents en ruine ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Infrastructures militaires et b\u00e2timents soumis \u00e0 des r\u00e8gles de contr\u00f4le et de confidentialit\u00e9, notamment ceux affect\u00e9s aux forces et services de s\u00e9curit\u00e9 ou aux syst\u00e8mes d&rsquo;information ;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Les b\u00e2timents commerciaux et de services situ\u00e9s dans des installations soumises au r\u00e9gime approuv\u00e9 par le<\/span> <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/decreto-lei\/71-2008-249821\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">D\u00e9cret-loi n\u00b0 71\/2008<\/span><\/a> <span style=\"font-weight: 400;\">du 15 avril, dans sa version actuelle.<\/span><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3><b>Am\u00e9liorations pour l\u2019efficacit\u00e9 \u00e9nerg\u00e9tique<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">En plus des exemptions, il est essentiel de consid\u00e9rer certaines am\u00e9liorations afin d\u2019augmenter l\u2019efficacit\u00e9 \u00e9nerg\u00e9tique, notamment :<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Isolation des murs
